De gemeente Haarlem is eigenaar van de kassen en gebouwen in de Haarlemmer Kweektuin. KweekZon kan daar natuurlijk niet zomaar zonnepanelen op leggen. In de afgelopen maanden is met de gemeente en de huurders van de ruimtes besproken welke daken benut zouden mogen worden. Dat is vastgelegd in een dakovereenkomst. De gemeente stelt de beschikbare dakoppervlakken om niet ter beschikking aan KweekZon voor een periode van 15 jaar. Op 10 september was het zover: de ondertekening bij de notaris van de akte ter vestiging van het recht van opstal.
